Well, this happens from time to time and in almost all cases, it's very rare uh that the insurance company is going to find that you have an ongoing total disability. So, even if your doctor is saying that you can't do your job or even any job, uh the insurance companies will set up IMES who will examine you and they may find that you have mild, moderate, marked or total disability, which is just a 25% 200% disability. Um what'll happen is very often if we have an opinion we don't like we can

00:00:29

negotiate these either through the carrier on the phone or we have to request a hearing and we can agree on something and if we can't agree on something uh we have to go to trial and what does that mean in trial and workers comp means the doctors are going to come in for depositions most often in New York state they're virtual and um your doctor will testify as will theirs we will cross-examine the insurance company's doctor to try to get them to concede uh certain things, you know, if we have

evidence that shows that you are you have a tear somewhere, a tear in your knee or tear in your shoulder or a herniated disc or we have a nerve conduction test that show that you cannot uh do certain things. The more evidence we have, the better we feel going up against these insurance doctors. Um, even though it slows the process down, very often when we have an IME that finds noticeability and we have a claimant that has significant injuries, we like going to trial because it's going to be very hard to argue that

there's nothing wrong with my client when we have this whole volume of evidence saying uh they may need surgery or they've had surgery, they're still recovering, they need treatment. Um, these are opportunities for us to show the judge the severity of your injuries and how we go forward and and move the case along and get you what you need from the case. That's that's what these hearings are for. There are supposed to be a an an independent form for us to present our evidence on your behalf.
