Hi, this is Aliyah Kahn, I'm one of the attorneys with Pulaski, Shelledy, and Rosen, and today I'll be talking about schedule loss of use. As you may know, whenever you injure an extremity in workers compensation, that is any arm, leg, shoulder, knees, toes, anything that's not your head, your neck, your back, or your abdomen, you're entitled to what we call the schedule loss of use at the end of the case. When you're done treating and your doctor thinks that you're as good as

00:00:24

you're going to get, your doctor will determine what percentage loss of use you have to that specific body part. Now, this determines the value of your case. Recently, we had a case where someone went out of work for a brief amount of time due to their injury, and they were found to have a large schedule loss of use. In this particular situation, that means that they were entitled to a larger award than they otherwise would have been. Now, the reason for this is because whenever you go out of work in

00:00:56

workers compensation, any money that you've been paid while you were out is deducted from your schedule loss of use. Because this particular client was only out for a short period of time, there was only a small deduction from their ending schedule loss of use. What this means is, because this person was able to work with their injury and recover while working, they were able to get a larger monetary award at the end of the case. Now, some people believe that because they're working, they may not be able to

00:01:27

get treatment through workers compensation. That's not true. While you're working, you are entitled to go to the doctor, to receive benefits, to have therapy. The only difference is that you're not receiving wages for being out of work because, again, you are working. So, in this particular case, this claimant walked away with a lot more money than they otherwise would have because they were able to return to work more quickly than some other peers of theirs, and therefore they had a a award

at the end of the case. And that is one of the things you should know about schedule loss of use in workers compensation.
